The legal status of the provider depends on the country and local regulations. The presence of institutional custody does not eliminate regulatory or technical risk. Counterparty risk remains—the risk that the other party will not fulfill its obligations.

Therefore, the difference between services is often manifested in the rules of control, and liability. For institutional clients, these conditions determine who has access to the assets and how transactions are recorded.
